A framework is awarded to several contractors on a UK basis, on the basis of the OJEU, selection and award on the most “economically advantageous” basis. Contractors offer a number of services in categories such as building, sewerage and electricity services. Hourly rates, calls and quality levels shall be set out in the framework contract. Where an appeal is necessary, the Authority shall be addressed to the contractor who, on the basis of the initial award criteria, submits the “most economically advantageous” tender for the needs in question. In this case, there is no need for a mini-competition, since there is no need to refine the conditions. Another approach could be to give a framework to a single contractor for each region. Most contracts are individual suppliers and, therefore, the purchasing process excludes everyone but one. However, there are many framework agreements in which buyers can collaborate with a number of suppliers. The purpose of the framework contracts between UNHCR and its suppliers is to define the conditions applicable to contracts to be awarded during a given period, in particular with regard to the item, price, quality, quantity and delivery. Here is an example of two agreements. Note that each project cancelled under the agreement has its own contract. A framework agreement is an excellent way to cooperate with public authorities. Once approved and eu-compliant, it can be credible to ensure future work in the public sector, both through a framework contract and an individual project contract.
Each Party represents and warrants to any other Party that the execution, provision and implementation of this Amendment has been approved by all necessary capital measures of that Party and that it is not contrary to the Articles of Association or Articles of That Party; and (b) that Party fully complies with all agreements and arrangements contained in the Framework Agreement as amended.
